  • Divorce: Going through a divorce may be one of the most difficult things that you go through in your life.  Dividing your family in two is complicated and emotional.  Whether contested or nominal, our attorneys will guide you through the divorce process. 
  • Child Custody and Visitation: If you have children, your divorce will have to address child custody, child support and visitation schedules.  Child custody and placement are determined on what is in the best interests of the child. We will advise you on the law and help you create a solution that is in both your and your children’s best interests.
  • Child Relocation/Move Aways: Relocation after a divorce is extremely emotional.  You may want to move away for a new job, to get away from an abusive spouse or to get remarried.  Or, you may be trying to prevent an ex-spouse from relocating with the children.  Moving children out of state and away from one parent is very difficult and the move will only be granted if it is in the best interests of the child.  The law in Rhode Island asks what is the reason for the move and then determines whether the move is in the best interests of the child.

  • Child Support: Rhode Island has adopted the income shares model to determine child support. It is based on the weekly gross income of both parents before taxes and before any other deductions.
  • Property Division: Usually this division is 50/50 but if a spouse has been mistreated, emotionally, physically or through infidelity, it may be grounds for awarding that spouse more of the marital assets.
  • Spousal Support/Alimony: This is dependent on many factors including the length of the marriage, the conduct of the parties during the marriage, and the age and health of the parties.
  • Post-Decree Modifications: Circumstances change and so must your divorce or custody order. Whether it be visitation schedules, spousal support or child support we can help you with modification disputes.
  • Domestic Violence: We can help protect victims of domestic abuse through temporary restraining orders.
  • Grandparent Rights:  Under Rhode Island law, grandparents and relatives have the right to petition the Family Court to visit with a grandchild and other relatives. Frequently it occurs that during or after divorce grandparents or relatives have been shunned by one spouse. Additionally, visitation with a family member or grandparent is sometimes curtailed when one of the child's parents has died.  Let us assist you in obtaining your rights as a grandparent.
